1) Scope of Application
1.1 These Terms and Conditions (hereinafter “T&Cs”) of BM International Holding B.V., Keizersgracht 391A, 1016EJ Amsterdam (hereinafter “Seller”) apply to all contracts concluded between a consumer or business customer (hereinafter “Customer”) and the Seller regarding the purchase of goods presented in the Seller’s online shop mybio.es. Conflicting terms of the Customer shall not apply unless expressly agreed otherwise.
1.2 These T&Cs also apply to contracts for the purchase of vouchers, unless explicitly stated otherwise.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business, or profession. A business customer is any natural or legal person or partnership with legal capacity acting in the exercise of their commercial or self-employed professional activity.
2) Conclusion of Contract
2.1 Product descriptions in the online shop do not constitute binding offers but serve as an invitation for the Customer to submit a binding offer.
2.2 The Customer may submit an offer using the integrated online order form. By completing the checkout process and clicking the final order button, the Customer submits a legally binding offer regarding the goods in the shopping cart.
2.3 The Seller may accept the Customer’s offer within five days by: ● sending an order confirmation via email or text form, ● delivering the goods, ● or requesting payment after the Customer has placed the order. The earliest occurring event constitutes acceptance.
2.4 If the Seller does not accept the offer within the specified period, the Customer is no longer bound by their offer.
2.5 The Seller stores the contract text after conclusion and sends it to the Customer via email. If the Customer has created a user account, order data may be accessed via the account.
2.6 Before submitting an order, the Customer may correct all inputs using standard browser and device functions.
2.7 Contracts may be concluded in English or German.
2.8 The Customer must ensure that the provided email address is correct so they can receive order communications.
3) Right of Withdrawal
3.1 Consumers generally have a statutory right of withdrawal.
3.2 Details are described in the Seller’s withdrawal policy.
3.3 The right of withdrawal does not apply to consumers who, at the time of contract conclusion, reside outside the EU and whose delivery address is outside the EU.
4) Prices and Payment Terms
4.1 All prices shown include applicable VAT. Additional shipping fees are listed separately.
4.2 For deliveries outside the EU, additional fees (e.g., bank transfer fees, customs duties, import taxes) may apply and must be paid by the Customer.
4.3 Payments may only be made through Stripe. Available Stripe-supported payment methods (e.g., credit card, Apple Pay, Google Pay) are shown during checkout.
4.4 Recurring Payments / Subscriptions
4.4.1 If the Customer purchases a subscription or recurring service, payment will be charged automatically at the interval specified during checkout (e.g., monthly, quarterly, yearly).
4.4.2 By completing the purchase, the Customer authorizes the Seller and Stripe to automatically charge the selected payment method for each renewal period until cancellation.
4.4.3 The Customer may cancel a subscription at any time in their account or by contacting the Seller. Cancellation takes effect at the end of the current billing period. Previously paid fees are non-refundable unless required by law.
4.4.4 If automatic payment fails, the Seller may suspend access to the purchased subscription or digital service until payment is successfully processed.
5) Delivery and Shipping Conditions
5.1 Delivery is made to the shipping address specified by the Customer.
5.2 If delivery fails due to reasons attributable to the Customer, the Customer must bear the resulting additional costs. This does not apply when exercising the right of withdrawal.
5.3 If the Seller cannot deliver due to non-availability of goods, the Customer will be informed immediately and refunded without delay.
5.4 Self-collection is not possible.
5.5 Delivery of Digital Goods / Instant Access
5.5.1 Digital goods (e.g., downloads, online content, memberships) are provided electronically after payment.
5.5.2 By completing the purchase, the Customer expressly agrees that the Seller begins fulfilling the contract immediately and acknowledges that the right of withdrawal for digital goods expires once access or download has begun.
5.5.3 For subscriptions or digital memberships, access is granted immediately after successful payment confirmation.
6) Retention of Title
The goods remain the property of the Seller until full payment is received.
7) Liability for Defects
7.1 Statutory defect liability applies.
7.2 For used goods, claims for defects arising later than one year after delivery are excluded, except where: â—Ź the goods are typically used in buildings and cause defects, â—Ź claims for damages apply, â—Ź or the Seller has fraudulently concealed the defect.
7.3 Consumers should report obvious transport damage to the carrier and notify the Seller. Failure to do so does not affect legal rights.
8) Redemption of Promotional Vouchers

8.1 Promotional vouchers issued free of charge can only be redeemed in the Seller’s online shop and within the validity period.
8.2 Promotional vouchers may only be used by consumers.
8.3 Restrictions may apply as stated on the voucher.
8.4 Vouchers must be redeemed before completing the purchase.
8.5 Only one promotional voucher per order is permitted.
8.6 Remaining balances are not paid out.
8.7 If the voucher does not cover the order value, the Customer may pay the difference using Stripe.
8.8 Voucher balances are not paid in cash.
8.9 If goods paid partly or fully with a voucher are returned, the voucher value is not refunded.
8.10 Promotional vouchers are non-transferable.
9) Redemption of Gift Vouchers

Gift vouchers can be redeemed only in the online shop and under the terms specified at purchase.
10) Applicable Law
Dutch law applies, excluding UN sales law.
11) Place of Jurisdiction
If the Customer is a business customer, Amsterdam shall be the exclusive place of jurisdiction.
12) Code of Conduct
The Seller adheres to no specific code of conduct unless stated otherwise.
13) Alternative Dispute Resolution
The EU Commission provides an online dispute resolution platform. The Seller is not obligated and not willing to participate in dispute resolution procedures before a consumer arbitration board.
